Klauzula Informacyjna RODO

W związku z koniecznością wypełnienia obowiązku informacyjnego wynikającego z przepisów Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) („RODO”) informuję, że:

1. Administratorem Pani/Pana danych osobowych jest Training & Solutions (Classic Sounds- Brand), z siedzibą w Krakowie 31-559, ul. Grzegórzecka 67c/38, NIP: 8731312735.
2. Administrator przetwarza Pani/Pana dane osobowe w związku z realizacją/negocjacją umowy zawartej przez Administratora z Pani/Pana Pracodawcą, z uwagi na wskazanie Pani/Pan jako osoby uprawnioną do kontaktu z Administratorem w bieżących sprawach związanych negocjacją/realizacją umowy.
3. Administrator przetwarza Pani/Pana dane osobowe na podstawie art. 6 ust. 1 lit. RODO – niezbędność przetwarzania danych osobowych do celów wynikających z prawnie uzasadnionych interesów realizowanych przez Administratora lub Pani/Pana Pracodawcę – w następujących celach:
4. realizacji umowy zawartej przez Administratora z Pani/Pana Pracodawcą lub podjęcie działań na żądanie Pani/Pana Pracodawcy przed zawarciem przez niego umowy z Administratorem,
5. w celu dochodzenia lub obrony przed ewentualnymi roszczeniami wynikającymi lub związanymi z umową łączącą Administratora z Pani/Pana Pracodawcą.
6. Administrator przetwarza dane osobowe, jakie zostały mu przekazane bezpośrednio przez Panią/Pana lub przez Pani/Pana Pracodawcę. Administrator przetwarza następujące kategorie danych:
   • imię i nazwisko,
   • numer telefonu,
   • adres poczty elektronicznej,
   • nazwa/firma Pracodawcy.
7. Pani/Pana dane osobowe mogą być przekazywane przez Administratora podmiotom świadczącym usługi na rzecz Administratora oraz podmiotom, którym Administrator ma prawny obowiązek udostępnienia przetwarzanych przez siebie danych osobowych.
8. Administrator nie będzie przekazywać Pani/Pana danych osobowych do państw trzecich ani organizacji międzynarodowych.
9. Administrator będzie przetwarzać Pani/Pana dane osobowe przez okres obowiązywania zawartej z Pani/Pana Pracodawcą umowy, a po jego upływie przez okres niezbędny do zabezpieczenia lub dochodzenia ewentualnych roszczeń przysługujących Administratorowi i obrony przed ewentualnymi roszczeniami – nie dłużej niż do upływu okresu ich przedawnienia lub prawomocnego zakończenia postępowania, których są przedmiotem.
10. Podanie przez Panią/Pana danych osobowych jest dobrowolne, jednak warunkuje możliwość nawiązania z Panią/Panem przez Administratora kontaktu w związku
    z procesem zawierania lub wykonywania umowy z Pani/Pana Pracodawcą. Odmowa podania danych lub żądanie ich usunięcia uniemożliwi Administratorowi taki kontakt.
11. Zgodnie z RODO, przysługuje Pani/Panu prawo do:
12. dostępu do swoich danych oraz otrzymania ich kopii,
13. sprostowania (poprawiania) swoich danych,
14. żądania usunięcia lub ograniczenia przetwarzania swoich danych osobowych,
15. wniesienia skargi do organu nadzorczego w sytuacji, gdy uzna Pani/Pan,
    iż przetwarzanie przez Administratora dotyczących Pani/Pana danych osobowych narusza przepisy RODO. Organem nadzorczym od dnia 25 maja 2018 r. jest Prezes Urzędu Ochrony Danych Osobowych.
16. Oprócz uprawnień, o jakich mowa w punkcie 9 powyżej, w każdej chwili przysługuje Pani/Panu prawo do wniesienia sprzeciwu wobec przetwarzania Pani/Pana danych, przetwarzanych do celów wynikających z prawnie uzasadnionych interesów realizowanych przez Administratora lub Pani/Pana Pracodawcę. Administrator zaprzestanie przetwarzania Pani/Pana danych osobowych w tym celu, chyba że będzie w stanie wykazać, że istnieją ważne, prawnie uzasadnione podstawy, które są nadrzędne wobec Pani/Pana interesów, praw i wolności lub Pani/Pana dane będą mu niezbędne do ewentualnego ustalenia, dochodzenia lub obrony przed roszczeniami.
17. Administrator informuje, że nie będzie przetwarzał Pani/Pana danych osobowych w sposób zautomatyzowany, na podstawie przetwarzanych przez siebie danych osobowych nie będzie podejmować decyzji w sposób zautomatyzowany, a Pani/Pana dane osobowe nie będą profilowane ani przetwarzane przez Administratora w celach marketingowych.
18. Może się Pani/Pan skontaktować z Administratorem w sprawie ochrony Pani/Pana danych osobowych na wskazany w punkcie 1 powyżej adres siedziby Administratora, za pośrednictwem poczty elektronicznej, pisząc na adres e-mai: office@classicsounds.pl

General Data Protection Regulation (GDPR) standard informational clause

In fulfilling the obligation to provide information arising from laws and regulations of the European Parliament and the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) („GDPR”) I hereby inform that:

1. The Administrator of your personal data is Training & Solutions (Classic Sounds Brand), based in Kraków, ul. Grzegórzecka 67c/38), NIP (Tax Identification Number) 8731312735, („Administrator”).
2. The Administrator is processing your personal data in connection with the execution/negotiation of the agreement concluded by the Administrator and your Employer, in virtue of designating you as a person entitled to contact the Administrator on current issues regarding the execution/negotiation of the agreement.
3. The Administrator is processing your personal data pursuant to Article 6, paragraph 1, letter f of the GDPR – an indispensability of personal data processing to fulfil objectives arising from the legitimate interests pursued by the Administrator or your Employer – for the following purposes:
4. realization of an agreement concluded with the Administrator and your Employer, or undertaking actions upon your Employer’s request prior to the conclusion of the agreement with the Administrator,
5. in order to assert or avert potential claims stemming from or connected with an agreement integrating the Administrator with your Employer.
6. The Administrator is processing personal data that were transmitted directly by you or your Employer. The Administrator is processing the following data categories:
   • first name and second name,
   • telephone number,
   • e-mail address,
   • Employer’s name/company.
7. Your personal data may be transferred by the Administrator to other entities providing services in the interest of the Administrator, and to entities for which the Administrator is legally obliged to provide personal data processed.
8. The Administrator will not transfer your personal data to third countries or international organisations.
9. The Administrator will be processing your personal data over the term of the agreement concluded by your Employer, and after the expiry date, over a period necessary to secure or pursue potential claims available to the Administrator, and to defend against potential claims – no longer than until their limitation period expires, or until the valid termination of the proceedings, which they are subject to.
10. Providing the personal data by you is voluntary, however it opens a possibility of getting into touch with you by the Administrator, following the process of concluding or performance of an agreement by your Employer. Refusing to provide personal data or demanding them to be removed prevents the Administrator from contacting with you.
11. According to the GDPR, you are entitled to:
12. access your data and receive copies of them,
13. rectify (correct) your data,
14. request the removal or restriction of processing your personal data,
15. lodge a complaint to the supervisory body in case you consider that processing by the Administrator concerning your personal data infringe the GDPR regulations. Since 25 May 2018, the President of the Office of Personal Data Protection is the supervisory authority.
16. In addition to the powers referred to in point 9 above, at any time you have the right to raise objections against the processing of your data, processed for the purpose arising from legitimate interests pursued by the Administrator or your Employer. The Administrator will cease processing your personal data, unless the Administrator can show that there are valid, legally justified grounds which have priority over your interests, laws and freedoms, or your data will be crucial for potential determining of, pursuing or defending against any claims.
17. The Administrator informs that will not process your personal data by automated means, will not make decisions by automated means on the basis of the personal data processed by the Administrator, and your personal data will not be profiled or processed by the Administrator for marketing purposes.
